Boletos Express Terms of Use

How these Terms are organized

  • Part A — General Terms (Sections 1–6): apply to everyone who uses the Site.
  • Part B — Fan Terms (Sections 7–14): apply when you buy, hold or use tickets.
  • Part C — Promoter Terms (Sections 15–25): apply when you create an event or sell tickets through Boletos Express.
  • Part D — Legal Terms (Sections 26–33): apply to everyone.

PART A — GENERAL TERMS

1. Agreement to These Terms

These Terms of Use ("Terms") govern your access to and use of www.boletosexpress.com, our promoter portal, mobile applications, box office, ticket printing, scanning and delivery services, and any related services (collectively, the "Site" or "Services") operated by Boletos Express Inc. ("Boletos Express," "we," "us" or "our"). Our Privacy Policy and any event-specific terms shown on an event page or at checkout are part of these Terms.

By browsing the Site, creating an account, purchasing tickets, or creating or selling an event, you agree to these Terms. Fans confirm their agreement by checking a box at checkout; Promoters confirm their agreement when creating a promoter account or publishing an event. If you do not agree, do not use the Services.

2. Definitions

  • "Fan" means anyone who browses the Site or buys, receives, holds or uses a ticket sold through the Services.
  • "Promoter" means any person or business that creates an event listing or sells tickets through the Services, including promoters, event organizers, producers, venues and artists, and anyone acting on their behalf.
  • "Event Organizer" means the Promoter responsible for a particular event.
  • "Agency Agreement" means any separate written agreement signed between Boletos Express and a Promoter.
  • "Ticket Price" or "face value" means the price of a ticket set by the Event Organizer, excluding service fees, taxes and optional charges.

3. Boletos Express's Role

Boletos Express provides a ticketing platform and acts as a limited agent of the Event Organizer to sell tickets and collect payment. Unless an event page clearly states that Boletos Express is the organizer, Boletos Express does not produce, control or guarantee any event, and the Event Organizer is solely responsible for the event, including its content, lineup, date, time, venue, permits, safety and any refunds owed.

4. Eligibility and Accounts

  • You must be at least 18 years old (or the age of majority where you live) to buy tickets or open a promoter account. Visitors under 13 may not use the Site.
  • You must provide accurate, current information and keep your login credentials secure. You are responsible for all activity under your account.
  • We may refuse service, suspend or close any account, or cancel any listing or order if we reasonably believe it involves fraud, a violation of these Terms, or a risk to Boletos Express, Fans or Promoters.

5. Acceptable Use

You will comply with all applicable laws and will not:

  • use the Services for any unlawful, fraudulent, deceptive or abusive purpose;
  • impersonate any person or misrepresent your affiliation with any person, artist or event;
  • use bots, scripts, automated software, multiple accounts or false identities to search for, reserve or buy tickets, or to circumvent ticket limits, queues or security measures;
  • scrape, crawl, data-mine or harvest information from the Site or its users;
  • interfere with the Site's operation, security or infrastructure, or impose an unreasonable load on it;
  • reproduce, alter, counterfeit, decode or reverse engineer tickets, barcodes or QR codes; or
  • post or transmit content that is unlawful, defamatory, harassing, hateful, obscene, or infringes anyone's rights.

6. Communications

By using the Services you agree to receive transactional emails and text messages about your account, orders, events and payouts (such as confirmations, delivery, event changes, postponements, cancellations, refunds and settlement notices). These are not marketing messages.

If you separately opt in to marketing text messages, you agree to receive recurring automated marketing messages from Boletos Express at the number provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help. You can unsubscribe from marketing emails using the link in any email. Carriers are not liable for delayed or undelivered messages.

PART B — FAN TERMS

7. Ticket Prices, Service Fees and Taxes

7.1 Total price shown before purchase. Before you select or pay for a ticket, the Site displays the total price of each ticket, including the Ticket Price and all mandatory fees, with a breakdown in the seat selection, cart and checkout (for example: "$150.70 ($131.00 + $19.70 in fees)"). Taxes, if any, and optional charges you choose (such as optional delivery methods) are disclosed before you complete your purchase.

7.2 Ticket Price. The Ticket Price is set by the Event Organizer, not by Boletos Express. Event Organizers may offer different prices for the same seat or section at different times, through price levels or tiers (for example presale, early-bird, general and day-of-show pricing), or through promotions. The price you pay is the price displayed and accepted at the time of purchase. We do not provide price adjustments or partial refunds if a price later changes.

7.3 Service fees. Service fees pay for Boletos Express's ticketing services, including the platform, payment processing, customer service, ticket delivery and entry technology. Service fees are separate from the Ticket Price, are disclosed before purchase, and are retained by Boletos Express and/or shared with the Event Organizer or venue under our agreements with them. Service fees are not part of the Ticket Price.

7.4 Face value. Your ticket or confirmation may show the Ticket Price separately from service fees. A total paid that exceeds the face value by the amount of the disclosed service fees, taxes and optional charges is not an overcharge and is not a resale above face value.

7.5 Pricing errors. If a ticket is listed at an incorrect price due to a typographical, system or human error, we may cancel the order and refund the full amount you paid, even after confirmation.

8. Orders, Delivery and Ticket Limits

  • Your order is accepted when we send an order confirmation. Review it immediately and contact us within 48 hours about any error.
  • Tickets are delivered electronically or by the delivery method you choose. Keep your ticket and barcode secure. We are not responsible for lost, stolen, duplicated or shared tickets; only the first barcode scanned will be admitted.
  • Event Organizers may set ticket limits. We may cancel orders that exceed limits, that we reasonably believe are fraudulent, or that were placed with automated software, multiple accounts or false information, and we will refund the amount paid for any canceled order.
  • A ticket is a revocable license to attend the event, subject to venue rules. The venue or Event Organizer may refuse entry or remove anyone who violates its rules, without refund.

9. Refunds, Cancellations and Postponements

9.1 All sales final. Except as stated in this Section or required by law, all sales are final. There are no refunds or exchanges for change of plans, inability to attend, lost tickets, or dissatisfaction with an event.

9.2 Canceled events. If an event is canceled and not rescheduled, you will receive a refund of the Ticket Price and service fees paid in full, to the original payment method. Refunds are funded by the Event Organizer; Boletos Express processes them on the Event Organizer's behalf.

9.3 Postponed or rescheduled events. Your ticket remains valid for the new date. Refunds for rescheduled events are available only if the Event Organizer authorizes them or if required by law; we will notify you of any refund window by email or text.

9.4 Weather and events beyond our control. You bear the risk of weather and similar conditions. If an event takes place, no refund is owed if you do not attend for any reason.

9.5 Event changes. Changes to opening acts, supporting performers, start times, production elements, or seat assignments of equal or better quality do not entitle you to a refund.

9.6 Chargebacks. Please contact us before disputing a charge with your bank. If you file a chargeback for a purchase you authorized, we may cancel the related tickets, restrict future purchases, and provide transaction records to your card issuer to contest the dispute.

10. Attending Events; Assumption of Risk

Live events involve inherent risks, including crowds, loud sound, lighting effects, and objects entering the audience. To the fullest extent permitted by law, you voluntarily assume all risks incidental to the event, before, during or after it, and you agree to follow venue policies, including security screening and age restrictions.

Events may be photographed, filmed or recorded. By attending, you consent to the use of your image and likeness in recordings and photographs of the event by the Event Organizer, venue, artists and Boletos Express for any lawful purpose, without compensation.

11. Ticket Transfers and Resale by Fans

Tickets are for personal use. Unless the Event Organizer permits it and applicable law allows it, you may not resell tickets for commercial purposes. Tickets obtained or resold in violation of these Terms may be canceled without refund.

12. Fan Accounts and Fraud Prevention

We may verify your identity, payment method or order before delivering tickets, and may request ID at pickup or entry. If we cannot verify an order, we may cancel it and refund the amount paid.

13. Reviews and User Content

If you submit reviews, photos, comments or other content ("User Content"), you represent that you have the right to do so and grant Boletos Express a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to use, reproduce, display and distribute it in connection with the Services. We may remove any User Content at our discretion.

14. Fan Questions and Complaints

Contact [email protected] or (800) 430-4202 with your order number. For questions about the event itself, we will forward your inquiry to the Event Organizer where appropriate.

PART C — PROMOTER TERMS

15. Promoter Accounts and Agency Agreements

To sell tickets, you must open a promoter account and provide accurate business, contact, banking and tax information (including a Form W-9 or equivalent). If you have signed an Agency Agreement with Boletos Express, that agreement controls over these Terms where the two conflict; these Terms govern everything the Agency Agreement does not address. You are responsible for all actions of your employees, agents and anyone using your promoter account.

16. Promoter Representations and Responsibilities

For every event you list, you represent, warrant and agree that:

  • you have the legal right and authority to hold the event and sell tickets for it, including all necessary venue agreements, artist agreements, licenses, permits and insurance;
  • all event information you provide (artist, date, time, venue, seating, prices, age restrictions, policies) is accurate and not misleading, and you will update it promptly if anything changes;
  • you will produce the event as advertised, or promptly notify Boletos Express and Fans of any cancellation, postponement or material change;
  • you will comply with all applicable laws, including consumer protection, ticketing, tax, accessibility, health and safety, and privacy laws;
  • your own advertising (social media, flyers, radio, email, websites) will comply with all-in pricing laws, including the FTC Rule on Unfair or Deceptive Fees and New York ticket pricing law, which require the total price including mandatory fees to be displayed whenever a price is shown. You are responsible for prices you advertise outside the Site; and
  • you will not inflate, misrepresent or conceal ticket prices, availability, or sales.

17. Pricing and Fees for Promoters

  • You set the Ticket Price, price levels and inventory for your events. Boletos Express displays total prices to Fans as described in Section 7.
  • Boletos Express service fees are charged according to the fee schedule shown in your promoter account or in your Agency Agreement. You may choose to pass service fees to Fans or absorb them, as permitted by your account settings.
  • Service fees charged to Fans are not part of the Ticket Price or gross ticket sales and are not owed to the Promoter, unless a written agreement signed by Boletos Express expressly provides otherwise. Settlement and payouts are calculated on the Ticket Price, not on the total amount paid by Fans.
  • Payment processing, chargeback, ticket printing, box office, scanning and other fees apply as stated in your fee schedule or Agency Agreement.

18. Collection of Funds, Settlement and Payouts

  • You appoint Boletos Express as your limited agent to collect ticket sale proceeds from Fans. Payment received by Boletos Express is treated as payment to you for purposes of the Fan's obligation.
  • Unless your Agency Agreement provides otherwise, Boletos Express will settle and pay out net proceeds (ticket sales minus service fees, processing fees, refunds, chargebacks and other amounts owed) after the event takes place, according to our standard settlement schedule.
  • Boletos Express may hold a reserve or delay payouts, in an amount and for a period we reasonably determine, to cover potential refunds, chargebacks, fraud, cancellations, or amounts you owe us, including for events that are postponed, at risk, or under dispute.
  • We may offset any amounts you owe Boletos Express (including from other events) against any payout.
  • You must review each settlement statement and report any error in writing within 30 days of receipt, after which the statement is final.
  • You are responsible for all taxes on your ticket sales, including sales, admissions and amusement taxes, unless your Agency Agreement says otherwise. We may issue information returns (such as Form 1099-K) as required by law.

19. Cancellations, Refunds and Chargebacks — Promoter Obligations

  • You are financially responsible for all refunds owed to Fans for your events, including refunds required by law, by these Terms, or by your published event policies.
  • If an event is canceled, Boletos Express may issue refunds to Fans directly from funds held for that event, and you must promptly reimburse Boletos Express for any refunds paid that exceed funds held, together with any non-recoverable processing and service costs.
  • You are responsible for chargebacks, payment reversals and associated fees on your events, except to the extent caused by Boletos Express's own error.
  • You may not refuse a refund that is required by law or by these Terms.

20. Fan Data Provided to Promoters

Boletos Express shares Fan names, contact information and order details with the Event Organizer for its events. As a Promoter, you agree that you will:

  • use Fan data only to manage the event, communicate with Fans about it, and market your own future events in compliance with law;
  • comply with privacy, anti-spam and telemarketing laws, including CAN-SPAM and the Telephone Consumer Protection Act — you may not send marketing text messages or autodialed calls to Fans without their prior express written consent;
  • honor opt-out requests, and not sell, rent or disclose Fan data to third parties except your service providers bound by confidentiality;
  • maintain a privacy policy covering your use of Fan data, and protect Fan data with reasonable security; and
  • notify Boletos Express within 72 hours of any unauthorized access to Fan data in your possession.

21. Promoter Content and License

You grant Boletos Express a worldwide, non-exclusive, royalty-free license during and after your use of the Services to use, reproduce, display, adapt and distribute the event names, artist names, images, logos, flyers, videos and other materials you provide ("Promoter Content") to list, market and promote your events and the Services, including on social media and in paid advertising. You represent that you own or have obtained all rights, licenses and consents (including from artists, photographers and designers) needed to grant this license.

22. Box Office, Complimentary Tickets and Entry

Complimentary tickets, holds, box office sales and on-site sales must be recorded through the Services or reported to Boletos Express as required by your Agency Agreement. You are responsible for ensuring venue staff scan tickets using Boletos Express's entry tools or another method we approve. Boletos Express is not responsible for admission decisions made by you or the venue.

23. Suspension and Removal of Events

We may pause sales, remove a listing, or suspend a promoter account if we reasonably believe an event is fraudulent, misrepresented, unlawful, at risk of cancellation, or generating excessive complaints or chargebacks, or if you breach these Terms or your Agency Agreement. Your obligations for refunds, chargebacks and amounts owed survive suspension or termination.

24. Promoter Indemnification

You agree to indemnify, defend and hold harmless Boletos Express and its officers, directors, employees, agents and affiliates from and against all claims, demands, lawsuits, arbitrations, government investigations, losses, damages, fines, penalties and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your events, including their cancellation, postponement, change, production, safety or injury to any person; (b) your Ticket Prices, advertising and promotional statements; (c) your Promoter Content; (d) your use of Fan data; (e) your breach of these Terms, your Agency Agreement or any law; and (f) any claim by a Fan, artist, venue or other third party relating to your event. Boletos Express may participate in or control the defense of any claim with counsel of its choice.

25. Promoter Liability Limits

TO THE FULLEST EXTENT PERMITTED BY LAW, BOLETOS EXPRESS'S TOTAL LIABILITY TO A PROMOTER FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE SERVICE FEES BOLETOS EXPRESS ACTUALLY RETAINED FROM THAT PROMOTER'S EVENTS DURING THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. This limit does not reduce Boletos Express's obligation to pay out net proceeds actually owed to you under Section 18.

PART D — LEGAL TERMS

26. Ownership and Limited License

The Site and its content, including text, designs, graphics, logos, software, ticket formats and barcodes, are owned by Boletos Express or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services in accordance with these Terms. You may not copy, modify, distribute, frame, mirror or create derivative works from the Site or use our trademarks without our prior written permission.

Copyright complaints (DMCA). Notices meeting the requirements of 17 U.S.C. §512(c)(3) should be sent to: Copyright Agent, Boletos Express Inc., 571 W 183 St, New York, NY 10033, [email protected].

27. Third-Party Services

The Services may link to or integrate third-party websites and services (including payment processors, venues and social media platforms). We are not responsible for third-party content, products, services or privacy practices.

28. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL TICKETS AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR MAKE ANY WARRANTY REGARDING ANY EVENT, WHICH IS THE RESPONSIBILITY OF THE EVENT ORGANIZER.

29. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

(a) BOLETOS EXPRESS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR TRAVEL, LODGING OR OTHER EXPENSES, ARISING OUT OF OR RELATED TO THE SERVICES, ANY TICKET OR ANY EVENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(b) FOR FANS, OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (i) THE TOTAL AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM, OR (ii) ONE HUNDRED U.S. DOLLARS (US$100). FOR PROMOTERS, SECTION 25 APPLIES.

(c) WE ARE NOT LIABLE FOR THE ACTS OR OMISSIONS OF EVENT ORGANIZERS, VENUES, ARTISTS OR OTHER THIRD PARTIES, OR FOR THE CANCELLATION, POSTPONEMENT OR CHANGE OF ANY EVENT, EXCEPT FOR OUR OBLIGATION TO PROCESS REFUNDS FROM FUNDS AVAILABLE AS STATED IN SECTION 9.

Some jurisdictions do not allow certain limitations of liability; in those jurisdictions our liability is limited to the fullest extent permitted by law. Nothing in these Terms limits liability that cannot be limited under applicable law.

Fan indemnification. Fans agree to indemnify and hold harmless Boletos Express and its officers, directors, employees and agents from claims and expenses (including reasonable attorneys' fees) arising from the Fan's violation of these Terms, misuse of the Services or tickets, User Content, or violation of law.

30. Dispute Resolution: Binding Arbitration and Class Action Waiver

30.1 Informal resolution first. Before starting arbitration or a small claims case, the party with a claim must send the other a written notice describing the claim, the relief requested, and the claimant's name, email, phone number and order or event number (if any). Notices to us go to: Boletos Express Inc., Attn: Legal, 571 W 183 St, New York, NY 10033, and [email protected]. The parties will negotiate in good faith for 60 days after the notice is received. Statutes of limitations are paused during this period. Completing this process is a condition to starting arbitration.

30.2 Agreement to arbitrate. Except as provided in Section 30.5, any dispute, claim or controversy between you and Boletos Express arising out of or relating to these Terms, an Agency Agreement (unless it provides its own dispute resolution terms), the Services, any ticket, purchase, price, fee, refund, payout, settlement or communication, or our relationship ("Dispute"), whether based in contract, statute, regulation, tort or any other legal theory, and whether arising before or after you agreed to these Terms, will be resolved exclusively by final and binding individual arbitration. The arbitrator, and not any court, will decide all questions about the scope, validity, enforceability and arbitrability of this Section 30, except that a court will decide disputes about Sections 30.6 and 30.8.

30.3 Rules for Fans. Arbitrations brought by or against Fans will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect (www.adr.org), as modified by these Terms. Filing, administrative and arbitrator fees are governed by the AAA's rules, and for Fan claims of $10,000 or less we will reimburse the Fan's share of those fees unless the arbitrator finds the claim frivolous. The arbitration may be conducted by video, telephone or written submissions, or in person in the county where the Fan lives or another mutually agreed location.

30.4 Rules for Promoters. Arbitrations brought by or against Promoters will be administered by the AAA under its Commercial Arbitration Rules, before a single arbitrator, seated in New York County, New York. The prevailing party in a Promoter arbitration is entitled to recover its reasonable attorneys' fees and costs.

30.5 Exceptions. Either party may (a) bring an individual claim in small claims court in the county where the Fan resides or in New York County, New York, if it qualifies and remains in that court; (b) seek injunctive relief in court to protect intellectual property rights or stop unauthorized use of the Services; and (c) Boletos Express may bring an action in court to collect amounts a Promoter owes, including refund and chargeback reimbursements.

30.6 Class action and jury trial waiver. YOU AND BOLETOS EXPRESS AGREE THAT EACH MAY BRING DISPUTES ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims of more than one person and may not preside over any class or representative proceeding, except as provided in Section 30.7. YOU AND BOLETOS EXPRESS EACH WAIVE THE RIGHT TO A JURY TRIAL.

30.7 Mass arbitration. If 25 or more similar demands for arbitration are filed against us by or with the assistance of the same or coordinated counsel or organizations, (a) the AAA's Mass Arbitration Supplementary Rules will apply; (b) the demands will be administered in batches of up to 50 claimants each, with one arbitrator per batch, and the remaining demands will be held in abeyance with no fees due until their batch proceeds; and (c) the parties will cooperate in good faith to select a small number of bellwether cases to be decided first. Statutes of limitations are paused for demands held in abeyance.

30.8 Severability. If any part of Section 30.6 is found unenforceable as to a particular claim or request for relief (such as public injunctive relief), that claim or request will be severed and stayed in court until the individual arbitrable claims are resolved, and the remainder of this Section 30 will remain in force. Nothing in this Section permits class arbitration.

30.9 Time limit. To the fullest extent permitted by law, any Dispute must be brought within one (1) year after the claim arises, or it is permanently barred.

30.10 Fan right to opt out. Fans may opt out of this agreement to arbitrate by emailing [email protected] or writing to Boletos Express Inc., Attn: Legal – Arbitration Opt-Out, 571 W 183 St, New York, NY 10033, within 30 days after first agreeing to these Terms. The notice must include the Fan's name, address, email, and a clear statement of opting out of arbitration. Opting out does not affect any other part of these Terms.

30.11 Changes to this Section. If we change this Section 30, the change will not apply to any Dispute of which we had written notice before the change took effect, and you may reject the change by notifying us within 30 days, in which case the prior version of Section 30 will continue to apply to you.

31. Governing Law and Venue

These Terms are governed by the Federal Arbitration Act and, to the extent not preempted, the laws of the State of New York, without regard to conflict-of-law rules. For any Dispute not subject to arbitration, you and we consent to the exclusive jurisdiction of the state and federal courts located in New York County, New York, except for small claims actions permitted in Section 30.5.

32. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and, for material changes, notify users on the Site or by email (and Promoters through the promoter portal or by email). Changes apply to purchases, event listings and use of the Services after the updated Terms are posted. The version of these Terms in effect when a Fan made a purchase governs that purchase, except as provided in Section 30.11.

33. General Terms

  • Entire agreement. These Terms, the Privacy Policy, any event-specific terms shown at checkout, and (for Promoters) any Agency Agreement are the entire agreement between you and us about the Services.
  • Severability. Except as provided in Section 30.8, if any provision is found unenforceable, the remaining provisions remain in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets.
  • Independent parties. Promoters and Boletos Express are independent contractors. Nothing in these Terms creates a partnership, joint venture or employment relationship.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including weather, natural disasters, epidemics, government action, labor disputes, or outages.
  • Language. We may provide these Terms in Spanish for convenience. If there is a conflict, the English version controls.
  • Survival. Sections that by their nature should survive (including Sections 7, 9, 10, 18–21, 24–31 and 33) survive termination.
